The recently passed appropriations bill includes the long-awaited SECURE Act and other retirement-related rules. Without question, it is the most significant change in retirement plan rules since PPA in 2006. Employers can adopt plans after the end of the year. Employers can add safe harbor 401(k) features after the year has begun, up to 12 months after the year has ended. There's no need for notices for safe harbor nonelective plans. RMDs have been pushed from 70 1/2 to 72, but there are limitations on stretch distributions for beneficiaries. Late filing penalties went way, way up. Certain part-time employees will have the right to defer, but won't be in the ADP test. There are expanded opportunities for MEPs and consolidated 5500 filing outside of MEPs. The Future Is Coming to the DOL: And It’s Electronic!

New MEP rules: Coming up!

The DOL just issued final rules allowing certain associations of employers and professional employer organizations to sponsor Multiple Employer Plans (MEPs) which can file a single 5500 and otherwise be treated as single ERISA plans. Both agencies and Congress hope that increasing the number of MEPs will increase the number of employees covered by retirement plans, particularly among small employers. Self-Correction of Participant Loan Failures: A brand new world!

After years of pleading for the option to self-correct participant loan failures, the IRS finally revised its plan correction procedure (EPCRS) to permit self-correction of some of the more common loan failures. These new correction options should save an employer considerable time and money. However, with the addition of improved correction options, the IRS likely will expect better compliance. Therefore, it is incumbent on practitioners to have a working knowledge of the new loan correction procedures. In less than 7 months after the IRS released the 2018 version of EPCRS, they’ve issued a new version, with important changes practitioners have requested. Most important, participants can now self-correct their loan defaults and not face a 1099-R! You can now self-correct certain plan document failures, but you have to be quick. And the IRS will allow retroactive amendments to handle benefits, rights, and features, such as in-service distributions, that were operationally available but not reflected in the plan document. Managing the 401(k), 403(b) and 457 deferral elections has transformed retirement plan administration from an annual event to an every-payroll affair. For each payroll period, employers, payroll administrators and plan administrators have to effect new participant elections, changes in elections and cancellations in elections. The chances for even a well-administered plan to make mistakes is significant. The costs for correction, not to mention the potential for plan disqualification, can be significant if the plan isn’t corrected quickly. Fortunately, the IRS has provided methods to correct such failures. Recently, the IRS has added less costly safe harbor correction methods. Unfortunately, the IRS retained the old correction methods and provided no explanation for how the two sets of rules interface. Participant Loan Failures: Self-Correction vs. VCP Correction

Participant loans continue to be a popular feature in defined contribution plans, particularly 401(k) plans. Navigating the numerous participant loan rules requires careful coordination between the employer, payroll administrator and the trustee. Unfortunately, the IRS has made participant loans a priority in IRS examinations. In recognition of the frequent loan issues and errors, the IRS, under its EPCRS program, has created correction methods a plan sponsor may use to resolve the errors. Because EPCRS does not address all of the loan errors, discussion of additional correction methods is necessary.
In this webcast, we will identify many of the common participant loan errors and review the various IRS provided correction methods for participant loans. We also will discuss whether the EPCRS correction method is the exclusive means of correction or whether there are alternative correction methods available. 5500 Update - 5/25/2017 and 8/17/2017. How long can practitioners dodge the bullet of 5500 “compliance questions?” Frankly, compared to what the IRS and DOL want to ask, the compliance questions appearing on the 2016 return are a “walk in the park.” The DOL and IRS filed a 777-page proposal for changes to revamp Form 5500. The additional questions may give many employers cause to reconsider the choices they have made for their plans.
